Craftly is a global marketplace where creative entrepreneurs connect with buyers looking for unique, handmade goods. By using our services, you're agreeing to these Terms of Use ("Terms"). Please read them carefully.

These Terms constitute a legally binding agreement between you and Craftly, Inc. ("Craftly," "we," "us," or "our"). When we say "Services," we mean all of our websites, mobile apps, and other products and services.

1. Using Our Services

Eligibility

You must be at least 18 years old to use Craftly. By using our Services, you represent that you meet this age requirement and have the legal capacity to enter into a binding contract.

Your Use of Craftly

You agree to use Craftly only for lawful purposes. You may not:

• Violate any laws, third-party rights, or our policies
• Use our Services if you're a person we've temporarily or indefinitely suspended
• Manipulate prices, feedback, or ratings
• Transfer your account credentials to another party without our consent
• Send unsolicited communications (spam) to other users
• Circumvent or manipulate our fee structure or billing processes

2. Your Content

You own the content you post to Craftly. However, by posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with our Services.

Content Standards

Your content must:

• Be accurate and not misleading
• Not infringe on anyone's intellectual property rights
• Not contain hate speech, harassment, or discrimination
• Comply with all applicable laws and our policies

3. Your Account

You're responsible for maintaining the security of your account and all activity that occurs under your account. You must notify us immediately of any unauthorized access.

We may suspend or terminate accounts that violate our Terms or policies, engage in fraudulent activity, or pose security risks.

4. Buying on Craftly

When you purchase something on Craftly, you're buying directly from a seller. Craftly is not a party to that transaction. Each seller sets their own policies for returns, exchanges, and shipping.

Buyer Protection

We want you to have a great experience. If something goes wrong with your order, our support team is here to help resolve issues between buyers and sellers.

5. Selling on Craftly

What You Can Sell

Craftly is a marketplace for:

• Handmade items: Goods that you make or design yourself
• Vintage items: Items that are at least 20 years old
• Craft supplies: Tools and materials for making things

Seller Responsibilities

As a seller, you agree to:

• Accurately describe items and their creation process
• Ship items within your stated processing time
• Respond to buyer messages promptly
• Honor your shop policies
• Comply with all applicable laws and regulations
• Pay all applicable fees

Verification Program

Craftly's Verified Artisan program helps buyers identify sellers who have demonstrated authentic handmade creation processes. Participation requires meeting our verification standards.

6. Fees & Payments

Selling on Craftly involves the following fees:

• Listing fee: $0.20 per listing for 4 months
• Transaction fee: 6.5% of the total sale price
• Payment processing: 3% + $0.25 per transaction

Fees may change with notice. Sellers are responsible for understanding current fees before listing items.

7. Termination

You may close your account at any time. We may terminate or suspend your account for violating these Terms, our policies, or applicable laws. Upon termination:

• You remain responsible for any outstanding obligations
• Provisions that should survive termination will remain in effect
• We may retain certain information as required by law

8. Warranties & Disclaimers

Craftly provides our Services "as is" without warranties of any kind. We don't guarantee that our Services will be uninterrupted, secure, or error-free.

Craftly is a venue for buyers and sellers to transact. We are not responsible for the quality, safety, or legality of items listed; the truth or accuracy of listings; or the ability of sellers to sell or buyers to pay.

9. Limitation of Liability

To the maximum extent permitted by law, Craftly is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Our total liability for any claims under these Terms shall not exceed the greater of $100 or the amount you paid us in the past 12 months.

10. Dispute Resolution

Informal Resolution

Before filing a legal claim, you agree to try to resolve disputes informally by contacting us at legal@craftly.to. We'll try to resolve the dispute within 30 days.

Arbitration

If we can't resolve a dispute informally, disputes will be resolved through binding arbitration rather than in court, except for claims in small claims court.

11. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we'll provide notice through our Services or by email. Your continued use of Craftly after changes take effect constitutes acceptance of the updated Terms.
